Pennsylvania: drunk driver suspected to have killed man in Philly wreck

A 19-year-old Philadelphia man is expected to face criminal charges after a late-night crash in Port Richmond left one man dead, police said Wednesday.
Police said they suspected the man, whose name was not released, had been under the influence of alcohol or drugs when his GMC van smashed into a Ford Windstar minivan on Richmond Street near Schiller Street about 11 p.m. Tuesday. He was undergoing tests Wednesday for driving under the influence of an intoxicant.
The driver of the minivan, Venustiano Vidals, 49, of Camden, was pronounced dead at the scene. Vidals was an immigrant from Puebla, Mexico, who lived in a trailer park with his wife, Eda; a 12-year-old daughter; and a 14-year-old son, his family said. He leased the single-wide trailer when he moved to the United States 15 years ago

Texas: hospital chairman blew into ignition interlock for his boozing son

SAN ANTONIO – The chairman of University Health System is caught on camera blowing into his son’s court ordered DWI intoxilyzer.
But Dr. Roberto Jimenez claims he didn’t know what he was doing.
I spoke with someone who’s close to this case.  When they heard Dr. Jimenez was claiming ignorance, their response was, “Oh, please!”
The respected and politically connected local psychiatrist says he had no clue what the strange black device, with a mouthpiece sticking out of it, was when his son called and asked him to blow into it last October.
Apparently, he also didn’t notice the camera pointed at him while he huffed and puffed into the thing.
Bexar County probation records show the intoxilyzer was issued to Jose Jimenez after his arrest for his second drunk driving charge.
When I asked Dr. Jimenez about the incident he told me, “No I didn’t, I didn’t really know what it was”.
His son told a probation officer a different story.
According to the probation records, “because the device was going to lockout (if he did not take the scheduled breath test) his father blew for him”

Maryland: Director of Federal Prisons busted for DWI; nearly ran into police vehicle

The Director of the Federal Bureau of Prisons was arrested and charged with DUI and related counts in late February after an Anne Arundel County police officer spotted him driving erratically near his home in Annapolis, according to a police report.
Harley Lappin, 55, was pulled over Feb. 26 after an officer watched him nearly swerve into a police speed-enforcement trailer on Arundel on the Bay Road and a parked car on Headwater Road, according to the police report. Lappin’s eyes were bloodshot, his speech was slurred and his breath smelled of alcohol, the report said. In field sobriety tests, he was unable to walk a straight line taking heel-to-toe steps, and he could not maintain his balance standing on one foot, according to the report.
The incident was first reported by Main Justice.
Late last week, Lappin announced that he would retire as director of the Bureau of Prisons effective May 7. ….MORE

Minnesota: man gets 4 years for 6th DWI conviction

A Lakeville man was sentenced last week in Becker County District Court on a felony charge of first-degree driving while intoxicated-test refusal.
James Karl Miller, 53, of 2342 Lucerne Trail, Lakeville, Minn., was ordered to serve 48 months in prison (conditional release after confinement was set at five years) and pay $135 in court fines and fees.
Additional charges, including one felony count of first-degree driving while intoxicated and one gross misdemeanor count of driving after license

Texas: former prosecutor defends Judge on probation for defendant in DWI case

A March 18 Express-News editorial (“Justice system is failing on DWI”) and subsequent letters to the editor criticizing Judge Pat Priest for his decision in the Clayton Don Stowe case are unfair to this honorable judge.
“Shock probation” was created by the Texas Legislature several years ago essentially to give the courts more latitude in sentencing individuals convicted of certain criminal offenses. The idea was to grant shock probation to someone without a prior criminal record in nonviolent and other type cases. DWI comes within that statute….MORE

Idaho Operation Lifesaver

Officer On A Train& and Adopt A Crossing& On Thursday March 31, City, County and State Law Enforcement Officers will be conducting an Officer On A Train& and A Crossing enforcement operation in North Idaho.
The purpose of this enforcement operation is to increase public awareness of the potential dangers that exist at highway railroad intersections and eliminate driver actions that can have tragic consequences, by enforcing the traffic laws that pertain to these intersections. The enforcement program is one of three parts of the Operation Lifesaver effort, which include engineering and education, designed to eliminate car train collisions.
During the Officer On A Train enforcement effort, one officer is placed in the lead locomotive of a train as a spotter. This officer observes traffic approaching the highway rail intersections as the train proceeds down the tracks. Other officers pace the train or are parked at specific locations. When a motorist is observed violating the laws pertaining to the approaching intersection, the officer on the train radios one of the chase cars which stop the motorist, explain the dangers and issue a citation.
With the Adopt A Crossing approach, City, County and State Law Enforcement officers from throughout Northern Idaho will pick a crossing within their jurisdiction and enforce the laws that pertain to the crossing.
During 2010, there were 16 car train collisions resulting in 4 people injured and 1 fatality. This year to date, there have been 2 car train collisions reported, resulting in 3 people injured.
Since 1990, the Officer On A Train and Adopt A Crossing programs have been instrumental in helping reduce the number of car train collisions in the state. City, County and State law enforcement, State and federal agencies, along with the private business and the railroads that operate in the state sponsor the Idaho Operation Lifesaver program.
