The police have eight breathalyzer machines and have discovered that five of them were not calibrated correctly, giving false readings.
1,147 cases were affected between September, 2009 and November, 2010. The issue came to light when defense attorney Charles Peruto raised an objection in court to a questionable breathalyzer result. He predicts there may be as many as 5,000 tainted cases and most of those defendants will walk. ….MORE

Four U.S. Senators are calling Apple to task over the availability of apps for the iPhone that can be used to alert users to the locations of drunk driving checkpoints. The Senators are asking Apple to remove titles that offer the feature from the App Store, calling the apps “harmful to public safety.”   ….MORE

Marine prosecutors want to bring even more charges against the former Cherry Point commander who was relieved of command after his DWI arrest.

An article 32 hearing, which is similar to a civilian grand jury, is underway today at the air station. Unlike a civilian grand jury, those hearings are open to the public.
The prosecution has brought up five additional charges they want the colonel to face. One is for reckless endangerment by assuming duty on flight. Prosecutors say Denn, who is a F/A-18 pilot, failed to acknowledge any human factors that impacted his flight the morning after his drunk driving arrest. Another possible charge is for making a false statement to his co-pilot that he had adequate rest the night before.
Prosecutors say they also want to charge the former commander with having a wrongful relationship with a civilian employee after being advised the appearance was not good for the workplace. Attorneys say there was no sexual relationship, just that Denn and the woman were too good of friends for the office. …MORE

EDITOR’S NOTE: For those who are sympathetic to this deputy for throwing away his career, remember, any off-duty officer who finds him or herself in the position of needing to travel after drinking has the same options as everyone else, to call a cab or a friend, in addition, he can likely call another cop to get a ride.   A taxi will cost about $25 bucks to get just about anywhere…see what you get out of a lawyer for 25 bucks…

Lillington, N.C. — A Harnett County deputy resigned last week after being charged with drunken driving, authorities said Tuesday.
The state Highway Patrol arrested Gary L. Boney early Friday in Johnston County and charged him with driving while impaired and driving left of center, authorities said. No other details of the were available Tuesday. ….MORE

Let’s see….we get a cop to go undercover to get the goods on drug dealers but he thinks its okay to get drunk and run into the citizens he is supposed to protect from drug dealers?  At least this guy had the decency to quit…

COVINGTON – An undercover narcotics officer with the St. Tammany Parish Sheriff’s office has resigned following a traffic accident early Monday morning inside the city limits of Slidell.
Slidell P.D. responded to the incident, which occurred on Old Spanish Trail. The off-duty deputy was found to be under the influence of alcohol and was charged with first offense DWI, a misdemeanor.   …..MORE
