South Carolina: chief judge orders backlog of drunk driving cases lessened

SOUTH CAROLINA – The state’s top judge has ordered a statewide effort to address a backlog in drunken driving cases. Chief Justice Jean Toal issued 132 orders on March 21 to courts across South Carolina to address all backlogged drunken driving cases within 120 days. The courts have 125 days to submit a report showing their compliance or substantial effort to comply with the order.
As of March 18, 12,153 criminal and traffic cases were pending in York County’s magistrate and municipal courts. Of those, 1,135 cases are for DUIs

Virginia: drunk deputy crashes into another police car while going wrong way on major highway

A Bedford County sheriff’s investigator has been placed on leave after his car collided with an Altavista police car early Sunday morning.
Inv. Joshua Hubbard faces multiple charges, including driving under the influence, after driving the wrong way on U.S. 29 in Campbell County about 3:15 a.m., State Police said.
No injuries were reported, and no other vehicles were struck during the 11 miles traveled in the wrong lane of U.S. 29.
Hubbard, who was off duty at the time of the crash, was placed on administrative leave pending an internal investigation, said Maj. Ricky Gardner of

    Illinois: town official was boozing it up at political fundraiser before he went wrong way and killed mother of four

    In his first court appearance since he allegedly caused a car crash last month that killed a mother of four, south suburban Lynwood Clerk Roel Valle this morning pleaded innocent to multiple charges.
    Valle, 64, sat in wheelchair because of severe injuries to his leg sustained in the wreck, his attorney, Ray Garza said. A public official for more than 20 years, Valle has been charged with one count of reckless homicide and six counts of aggravated drunken driving, according to the Cook County state’s attorney’s office.
    “This is a tragic case,” Valle’s attorney, Ray Garza said. “(Valle) is grief stricken about the loss here. He is beside himself, to say the least.”
    It’s not clear if Valle, who broke his right femur and his left arm in the crash, still is the Lynwood clerk. Garz deferred questions about Valle’s employment status to the village. Mayor Eugene Williams has not returned messages for comment.
    Valle declined comment after the brief court hearing. He is due in court May 2.
    Prosecutors alleged that on Feb. 3, Valle attended a political fundraiser, where he drank at an open bar, then left and drove a village-issued 2008 Ford Taurus to nearby Northwoods Saloon in Crete. There he drank alcohol at the bar for about an hour before getting back in the car headed for another bar, prosecutors said….MORE

    North Carolina: boozing bozo going wrong way zooms head-on into pickup, kills 2

    A driver has been charged with DWI in a wrong-way collision that killed two people in Greensboro early Friday morning.
    Ian Michael Smith, 20, of Archdale, was fleeing police on the wrong side of the road in a 2007 Mitsubishi Eclipse when he collided head-on with a 1995 Chevy pickup truck around 2:15 a.m.
    Smith was charged with driving while impaired and driving after drinking while underage.

    North Carolina: Judge in trouble for extra effort to ease the pain for DWI driver

    For the second time in a year, Mecklenburg District Judge John Totten is in trouble – this time facing misconduct charges for allegedly suppressing a drunken driving defendant’s alcohol level so the man wouldn’t be punished as harshly as N.C. law requires.
    Totten is accused of signing an order he knew or should have known was “false and misleading,” allowing the DWI defendant to avoid having an interlock device installed on his car.
    The device, which prevents convicted drunken drivers from starting their cars if they’ve been drinking, is required for drivers whose blood alcohol level is .15 or more.
    In this case, defendant Glenmore Hopkins pleaded guilty with an alcohol level of .17 – more than twice the legal limit of .08.   ….MORE

    Texas: Officer who quit after DWI arrest still to face trial

    SAN ANTONIO — A former San Antonio police officer who accidentally killed a civilian in 2006, is set to go to trial on a DWI charge.
    A Bexar County grand jury did not indict Winder Morales in that 2006 fatal accident, but in November of 2009, Morales was arrested on a separate DWI charge.
    Morales is fighting that case and is heading  to court Monday afternoon.
    The 34-year-old is accused of drinking and driving on Highway 90 at General McMullen.
    He was in an unmarked police car and off duty at the time when authorities say he crashed into a traffic barrier rolling the city vehicle.  …MORE

    New York: Judge gives man probation for DUI; has prior DUI fatal hit and run on record

    Syracuse — A Syracuse man who left the scene after a fatal hit-and-run crash six years ago was sentenced today to five years of probation in a recent drunken driving case.
    Sean Vazquez, 40, of 308 Duane St., was sentenced by state Supreme Court Justice John Brunetti based on the recommendation by the probation department. Vazquez was arrested Nov. 2 after police spotted him driving through a stop sign on Lodi Street while using a cell phone.
    The sentence for felony drunken driving includes electronic home confinement. Vazquez will also need to install an interlock device in any vehicle he drives. His lawyer Laurin Haddad said he has no vehicle.…..MORE

    Connecticut: bozo tried the handicap ramp at club, scored DUI

    Bradford Biggers, 53, of 39 Imperial Ave., was arrested March 22 at approximately 9:30 p.m. after he reportedly tried to drive up the handicapped-access ramp at the Westport Woman’s Club.
    Officers dispatched to the scene found Biggers driving in the club’s parking lot, and noticed that the ramp had been damaged. When they spoke with Biggers, alcohol could be smelled on his breath, police said. Biggers also failed field sobriety tests, police said. …MORE
