California: Teen dead, teen charged with DWI; ride with a drunk, buy a ticket to your own funeral

A 16-year-old Olivehurst boy was killed early today when the car in which he was a passenger overturned after going off the road in West Linda, striking a pole and a parked vehicle, the California Highway Patrol reported.
The car’s driver, another 16-year-old, from Marysville, was arrested in connection with the crash.
No identities were released because of their ages.
The accident occurred at about 3:30 a.m. today, when the 2003 Mitsubishi failed to make a curve on Feather River Boulevard, south of Riverside Drive because of high speed….MORE

Oklahoma: Whatameathead! Cops say football coach charged with DUI when found asleep in drive-thru lane of Whataburger!

TULSA, Oklahoma -Ben Bowling, the new head football coach at East Central High School, was arrested at 3:15 a.m. Sunday after police said he was asleep drunk in his car in a Whataburger drive-thru lane.
Bowling was arrested on a driving under the influence, actual physical control of a motorized vehicle complaint.
After being booked into jail by Tulsa Police at 4:15 a.m., Bowling bonded out at 8:30 a.m.
Court records show Bowling was previously charged with misdemeanor DUI while employed by Muskogee Public Schools in 2008.
According to the police booking sheet, Bowling was asleep, sitting in the drive-thru lane at Whataburger, located at 5726 E. 41st St. Bowling was in the driver’s seat with his vehicle running, the radio on, and the car was in park, the report said….MORE

TAMPA — A drunken driver heading the wrong way on a darkened road without headlights struck a Hillsborough County patrol cruiser early Sunday, pinning the injured deputy inside the car, authorities said.
The deputy’s rescue, sheriff’s spokesman Larry McKinnon said, then played out like a scene from a movie.
It started around 1 a.m. as a 2001 Ford Excursion traveled east — but in the westbound lanes — on Bearss Avenue, McKinnon said.
Headlights off, the sport utility vehicle went into the grass median near the Jimmie B. Keel Regional Library at 2902 W. Bearss Ave. in northwest Hillsborough.
The SUV hit a small tree but kept going to the end of the median, continuing east into the westbound lanes again.
Hillsborough sheriff’s Deputy Juan Lazu’s cruiser burned after colliding with Angel Pena’s SUV, which also burst into flame. Pena reportedly drove into Lazu’s lane.

Texas: Judge orders DWI killer to stand on street corner with sign around neck telling the world he took a man’s life

A judge in Houston sentenced a convicted drunk driver to humiliation. The drunk driver killed another man when he crashed into his car. Now the whole city will know what happened.
In June of 2011, 20 year old Aaron Pennywell was killed when he was struck by 38-year-old Michael Giacona.
Saturday, Giacona will re-visit the scene, but not because he wants to.
Harris County Judge Mike Fields has ordered him to spend the next four Saturdays out there from 9 a.m. to 5 p.m. while wearing a sign that says he killed Pennywell.
“Maybe we should try shaming people more often,” said retired Travis County Judge Jon Wisser.
Retired Travis County Judge Jon Wisser says he’s never done something this unique, but he’s not against it.
“The law permits a judge to use any reasonable means of punishment,” Wisser said. “The old days we had stocks put people in a public square. We put their arms and hands through things tried to shame them and humiliate them. This is a throw back to that. Maybe we ought to try and humiliate and shame defendants and maybe that will prevent them from doing that again.”
Not everyone thinks wearing a sign is appropriate even if a death is involved.
“I think it’s a little barbaric. I feel like I’m re-reading the Scarlett letter. I don’t think it’s fair,” said Austinite Keana Culjak-Reif. ….MORE

Maryland: Three judge panel opts for reduced sentence for Kevin Coffay; decision will allow him eligibility for parole in 12 months

ROCKVILLE, MD (WUSA) — Victims’ families reacted with tears and fury Friday night after a three judge panel dramatically cut the sentence for a man who admitted killing three of his friends and fleeing the scene last year in a drunk crash that killed three teens.
The panel cut the 20 year sentence imposed on Kevin Coffay in January to eight years. He will be eligible for parole as soon as next May.
Patrick Hoover, John McQuire and Doug Datt — all fathers who lost their children in the crash last May — said the sentence is like putting a sign out at the county limits, “drunk drivers welcome here.”
Judge Terrance McGann announced the unanimous decision of the three judges. He said, “Kevin Coffay must be incarcerated, but his life should not be wasted or destroyed.” He said the 20 year sentence far exceeded sentencing guidelines. And while he said there is a “culture of recklessness” and excessive drinking among teenagers, he said, “we will not place blame at Kevin’s feet,” for the alcohol…MORE

Florida: man sentenced to ten years for his 10th DUI still has court date for his 11th DUI pending

TAMPA –James Vernon Smith Jr. says he’s not your typical drunk.
And typical he is not.
The 48-year-old former underwater welder who lives in Louisiana but has family in the Tampa area was handed his 10th drunken-driving conviction Thursday in Hillsborough Circuit Court.
He was sentenced to 10 years in prison despite an emotional plea by Smith, the father of two young daughters. He said he was ashamed and sorry for his actions, and he cried and paused often while reading a handwritten letter in court.
“I have often been handed the keys to the kingdom,” he told Circuit Judge Kimberly Fernandez, “only to have left them on the bar somewhere.”
Smith was arrested in August 2011 and charged with driving under the influence for the 10th time. He also was charged with driving with a permanently revoked driver’s license. He was released on bail and within a couple of weeks had been arrested on his 11th DUI charge. That case is scheduled for court next month. ….MORE

Kevin Coffay and several friends had left a party. Coffay was drunk, and he slammed a Toyota Corolla into a tree on the side of a Montgomery County road about 3 a.m.
 

Coffay crawled out from behind an airbag and slipped into the woods. Police and tracking dogs found him hours later and miles away, his blood-alcohol level still double the legal limit for driving. Three of his friends were dead or dying. ….MORE

Now, he’s hoping others will learn from his story.
On New Year’s Day 2008, Micah Henry got behind the wheel drunk. He slammed into a pickup truck in the north valley, killing two people inside.
