Illinois: defense attorney blames death of victim of drunk driver on the victim’s own health history

WOODSTOCK – Prosecutors say a Marengo man accused of driving drunk and killing a truck driver who was walking across the street had 10 drinks over the course of about five hours before the incident.
Assistant public defender Kim Messer conceded that Daniel K. Bending consumed alcohol that day, but said the man Bending struck, 77-year-old Leonard Anderson, had pre-existing health problems that led to his death and delirium tremens, DTs, from alcohol withdrawal.
The incident happened about 8:45 p.m. April 18, 2008, as Bending, 49, was traveling east on Route 20 in Marengo.  ….MORE

New York: NFL’s Goodell tells all 32 teams to keep their drunken players on the field and off the roads

Commissioner Roger Goodell sent a memo to all 32 teams asking them to reinforce the dangers of driving while impaired.
In light of recent DUI incidents, Goodell is expected to seek harsh penalties for players charged in alcohol-related incidents. At present, players are fined the equivalent of a game check up to $50,000, but Goodell hopes to increase the punishment as part of the new substance-abuse policy. That policy would be enacted when the league and NFLPA find middle ground in their ongoing debate on HGH testing.
The memo, published by CBS Sports, also instructs team officials to remind players to avoid “trouble spots and places that don’t provide adequate security” but “don’t try to provide your own security by carrying a weapon.”
The memo reads:
“There have been several negative law enforcement incidents in recent months involving both players and non-player employees. These incidents primarily have involved alcohol or drug-related offenses, specifically driving while impaired.  ….MORE

Missouri: Melinda McCann faces time in the slammer on charges of injuring three in DWI crash

A St. Peters woman has been accused of driving drunk and causing a four-vehicle crash that injured three others on March 9.
Melinda C. McCann, 43, of the 300 block of Almond Tree Drive, has been charged with three counts of second-degree assault. McCann was driving a Chevrolet Silverado truck east in the westbound lanes of North St. Peters Parkway near Jungermann Road when she hit an oncoming Dodge Nitro head-on. The woman, 28, driving the Dodge was seriously injured. McCann suffered moderate injuries.
After the head-on crash, two other vehicles were struck as well, police said….MORE
