North Dakota: Judge Steve Dawson allows DUI offenders to lessen jail time by attending funeral of drunk driving victims

FARGO — As part of his punishment for drinking and driving, the Fargo man was given a choice: attend the funeral of a West Fargo family killed by a drunken driver heading the wrong way on Interstate 94 or serve five more days in jail.
He chose the funeral, and the next day he penned a letter to the court describing its effect on him.
“It made me sick to my stomach 4 lives were taken when they had a lifetime they never got,” he wrote.
The author, Allan Bakkerud, 55, was among three DUI offenders to whom Fargo Municipal Judge Steve Dawson gave the option of
attending the funeral of Aaron and Allison Deutscher and their 18-month-old daughter, Brielle, in lieu of jail time.
“I think it’s useful for people to realize just what kind of tragedy can result from their behavior, and how it affects real lives and

Montana: crime lab expert Lynn Kurtz, who testifies in DWI trials, busted for DWI

A state Crime Lab toxicologist who testifies frequently in court about blood alcohol content was charged with driving under the influence after a breath test put his alcohol level at twice the legal driving limit.
The charge last month against Lynn Kurtz is a misdemeanor because, if he’s convicted, it would be a first offense. He’s also charged with rolling through a stop sign, another misdemeanor.
Kurtz will continue to do casework at the Crime Lab while his case proceeds through court, Judy Beck, a spokeswoman for the state Attorney General’s Office, said Tuesday.
The Crime Lab also is notifying any attorneys who may have subpoenaed Kurtz as an expert witness, she said. Also, the Crime Lab notified its accreditation agency of Kurtz’s arrest.
A Missoula County sheriff’s deputy stopped Kurtz’s black 1994 Chevy just before 11 p.m. on June 25 ….MORE

NEWARK, Ohio — A Licking County man was sentenced to 45 days in jail today for the drunk-driving crash that killed his younger brother.
Gary Fellure, 51, of Licking Township, faced a stiffer sentence – as much as five years – in the Jan. 1 crash that left Bruce Fellure dead on his 49th birthday. But Bruce Fellure’s family members pleaded with Licking County Common Pleas Court judge David Branstool not to send Gary Fellure to prison.
“My uncle Gary’s a great guy, and I don’t want to lose him because of this,” said Kalie Fellure, Bruce Fellure’s 17-year-old daughter. “Taking him away is only taking away another meaningful person.”

– The parents of a local college student killed in a drunk driving crash last week hope their son’s death serves as a reminder of the perils of drunk driving.
A memorial service is planned for Friday night to honor 19-year-old Leo “Trae” Roybal who was the victim of the crash last week on the west side of the Valley.
The service will be at Epic Church (8755 W. Warm Springs) at 7 p.m.
Proceeds will benefit MADD (Mothers Against Drunk Driving).
“Nothing will ever bring back our son. It just hurts so bad,” grieves Bernie Roybal.  “Drinking and driving –we’ve got to stop it. We’ve got to figure out a way to teach people that drinking and driving kills.”
Danette and Bernie Roybal, Trae’s parents, describe him as athletic, smart, and musically talented.

SPOTSYLVANIA — A former Spotsylvania County prosecutor was convicted in Spotsylvania County General District Court on Friday for driving while intoxicated, seven months after crashing a Porsche Cayenne into another vehicle, causing a three-vehicle wreck on Salem Church Road in December.
Former Richmond Judge Thomas O. Jones, who retired from the 13th District in 2009, was brought in as a special judge to preside over this case.
