Virginia: Gov. Bob McDonnell signs new law requiring ignition interlock for first time DWI offenders

Virginia Governor Bob McDonnell signed a bill into law Tuesday that will crack down on drunk driving in the state.
Under the new law, anyone convicted of a DUI, even first-time offenders, will have to install an interlock device into their car.
The device prevents a car from starting if the driver’s blood alcohol content (BAC) is above .02. The offender is responsible for the cost associated with the installation and monitoring of the device.
In a statement, McDonnell said, “…Just one drunk driver on the road is unacceptable, and I hope that as we spread awareness of this law, that individuals who may otherwise consider driving impaired will be deterred by the consequences of that potentially deadly decision…”  …MORE

Florida: Hermes Suarez charged with DUI manslaugher in deaths of three people

Hermes Suarez, 31, was charged with six counts of DUI manslaughter seven months after a deadly accident that killed three people in Plantation.

A 31-year-old man was charged with six counts of DUI manslaughter on Wednesday, nearly seven months after a deadly auto accident, according to Plantation Police.
Hermes Suarez is accused of hitting and killing three people on the 6900 block of W. Broward Blvd., in Plantation on Jan. 21, police said.
Cheresa Nave, 22, of Fort Lauderdale, and Megan Kea, 22, of Sunrise, were in a single-car accident involving a tree about 4:30 a.m. and
Andrew Edmond, 24, of Plantation, stopped to help, according to the investigative report.

California: Rachel Lynn Walbye charged with DUI manslaughter after crashing, killing David Rivera who was in wheelchair

HESPERIA • A suspected drunken driver veered off the roadway, late Tuesday, striking a power pole and flipping a man in a motorized wheelchair, killing him, officials said.
David Rivera, 40, of Victorville, was traveling north on Seventh Avenue near the Manzanita Street intersection in Hesperia about 9:53 p.m. when he was struck by a Jeep approaching from behind, coroner’s and sheriff’s San Bernardino County Sheriff’s officials said.
Paramedics pronounced Rivera dead at the scene.
The driver of the vehicle, Rachel Lynn Walbye, 23, of Victorville, was treated for minor injuries and arrested on suspicion of gross
vehicular manslaughter while intoxicated, officials said. She was taken to West Valley Detention Center and her bail is set at $250,000, according to jail records.

LONGMONT — A man accused of driving under the influence and causing a wreck that resulted in a pregnant Longmont woman losing her unborn baby posted a $100,000 bond Tuesday and was released from the Boulder County Jail.
Officers arrested Gary Sheats on the 1200 block of Winslow Circle, after a witness followed him from the crash at 17th Avenue and Pace Street on July 5. According to reports, he drove on the rim of one of the tires on the Dodge Durango he was driving. ….MORE

California: lawmaker Roger Hernandez says he wasn’t too drunk to drive as day of trial advances

MARTINEZ — Jury selection began Wednesday afternoon in state Assemblyman Roger Hernandez’s misdemeanor drunken-driving trial, after a judge ruled that a Concord police officer had just cause to pull over the Southern California legislator in May.
Contra Costa Superior Court Judge Mary Ann O’Malley denied a motion to suppress evidence brought by Hernandez’s defense attorney Peter Johnson, who argued that Hernandez, D-West Covina, did not drive or behave in any manner to justify the traffic stop or subsequent DUI investigation.
Hernandez, 37, is accused of driving with a .08 percent blood-alcohol level — the legal limit in California — after admittedly having drinks with a woman in downtown Concord.
He has said he doesn’t believe he was too intoxicated to drive, and that Johnson will be challenging Contra Costa County’s blood-testing process at the trial.

Titans wide receiver Kenny Britt said he’s worried about a potential NFL suspension after his meeting on Monday with Commissioner Roger Goodell. Britt, in his first public comments of training camp, declined to discuss specifics of the meeting.
“It was a personal meeting and I would rather just wait and see what happens,” Britt said on Wednesday. “I am a man about what I did and I will take it on the chin on whatever he decides and move forward.
“What is my gut telling me? I really don’t know. He didn’t really give me any body language on what is going to happen. He just wasn’t really pleased about seeing me in there. No person would like to see a player in their office twice in one year.”

New York: Judge gave $250 fine to Anthony Webb for killing Clara Heyworth; also sent to drunk-driving “program”

Clara Heyworth was killed last summer while walking with her husband in Fort Greene by an unlicensed, possibly drunk driver that was ultimately not charged with a felony. Today, a Brooklyn judge sentenced that man, Anthony Webb, to a drunk-driving program but no jail time, and fined him $250 for operating a vehicle without proof of insurance and against the restrictions of his learner’s permit.
Despite the Brooklyn D.A.’s recommendation of a fifteen-day jail sentence, “It was pretty clear that the judge was frustrated by the failure to press more serious charges in this case,” said Heyworth’s husband Jacob Stevens, who is suing the driver and the NYPD for its botched investigation. “It’s a travesty that these more serious charges won’t be heard in criminal court.”
Heyworth’s story has helped shine a light on the broken NYPD practices in accidents involving cyclists and pedestrians. Because she did not die immediately, but in the hospital the following day, the department’s Accident Investigations Squad did not conduct a full survey of the crash

NORTH BEAVER, Pa. – Police have charged a 19-year-old man with drunken driving and vehicular homicide in connection with a crash that
killed his brother earlier this year.
State troopers in New Castle said 22-year-old Sean O’Hara died on the morning of June 24 when the pickup truck he was in hit a utility pole and flipped.
The driver, Ryan O’Hara, lost control of the vehicle on Route 168 near Benedict Lane at about 10:30 a.m., police said.
Neither brother was wearing a seatbelt, according to police. Sean O’Hara was ejected and killed, and Ryan O’Hara was flown to a hospital.
Police said Ryan O’Hara’s blood-alcohol content was more than three times the state’s legal limit of 0.08 percent. …MORE
