by admin ·

From Daily Herald
Since early May, people have donated more than $12,000 to a Hampshire family on the verge of losing their home after being struck by an uninsured drunken driver on Christmas Eve 2008.
The crash injured Francisco Valdez, his four children and his father-in-law.
Valdez was driving to Provena St. Joseph Hospital in Elgin to visit his wife, Diana, who had a stroke a month earlier.
Francisco Valdez suffered a broken back in the crash and has been unable to return to work; the Valdezes’ home was sold in a foreclosure auction in late July.
Diana Valdez said her oldest son, Francisco Jr., moved to a Detroit suburb to attend college and pursue a career in law enforcement, while the remainder of her family is going to move to Rockford to live with relatives.
“We still have to move by the end of the month,” she said. “But the rest ….MORE

Pennsylvania: Gerald Dean Johnson admits he is an alcoholic and says he is sorry as he strikes plea deal in woman’s death; $12,000 restitution and 3 years in slammer

by admin ·

“I find it truly ironic that she would be killed by the thing she despised so vehemently,” son Christopher Hebenstreit, 35, of Silva, N.C., wrote in a victim-impact statement read aloud in court.

From York Dispatch
A Jackson Township man cried Friday in York County Court as he apologized for killing Victoria Holt in an alcohol-fueled crash.
Then Gerald Dean Johnson expressed gratitude to two of Holt’s sons, who took the unusual step of visiting Johnson at his home to say they forgave him.
That happened before he pleaded guilty Friday to homicide by vehicle while driving under the influence and DUI.
“You all have done something for me I can’t do for myself,” he said of their forgiveness. “This is something I live with every day.”
Johnson, 54, of Chesapeake Estates, was sentenced to three to six years in state prison as part of a negotiated plea agreement. He must also pay nearly $12,000 in restitution.
Johnson admitted he’s an alcoholic, but said he’s been sober since July 31, 2011 — the day of the crash.
The background: It happened on South Salem Church Road at Ruppert Road in Dover Township when Johnson was driving his Toyota Camry and turned left in front of Holt, who was riding a motorcycle, Northern York County Regional Police said.
Holt, 55, of Fox Chase Drive in Dover Township, suffered fatal injuries despite wearing a helmet. A 9-year-old child riding on the motorcycle escaped injury, as did Johnson. ….MORE

North Dakota: letter writer to newspaper says vehicle should be forfeited for three-time losers for DUI

by admin ·

Grand Forks Herald
MINOT — About 20 years ago, a drunken individual crossed the center line north of Jamestown, N.D., and killed two of the passengers and severely injured one of the other occupants in the car that was hit. The driver had no valid driver’s license or insurance and was driving his mother’s car.
The problem was, “how can society prevent such an incident?” I believed, and still do, that the only way to prevent this from happening is to restrict the availability of a drunken person from getting a car. My proposal was to confiscate and sell the car involved at the time of the third DUI offense…MORE
