Pennsylvania: Supreme Court rules that Robert J. Kidwell III who killed Daniel Gallagher while drunk driving, spent six months in the slammer, can keep his law license

A Stroudsburg lawyer convicted in the January 2009 drunken driving death of a Bushkill man will receive a public censure from the Pennsylvania Supreme Court, but no suspension of his law license.
Robert J. Kidwell III, 32, pleaded guilty in October 2010 to driving under the influence and no contest to involuntary manslaughter. He served six months in Monroe County Correctional Facility — four months of that on daytime work release — in the death of Daniel Gallagher, 22.
Kidwell, who also was fined $500 plus court costs, was paroled in April 2011. He could have received at least three years in state prison had he been convicted of the more serious charge of vehicular homicide.

MILTON — A Milford driver who led police on a high-speed chase, then crashed a Dodge pickup truck on Coastal Highway near Milton before he was apprehended in a Milton cornfield was charged with drunken driving — his fifth DUI in two decades.
Forty-year-old Josephi Anastasi also was charged with resisting arrest, disregarding a police officer’s signal, driving on a suspended license and speeding in excess of 55 mph on a four-lane, divided roadway, according to Delaware State Police.

Tennessee: Not satisfied with being locked up on DUI charges, police say Jacob Colby Trent threatened deputy and his entire family including his grandmother

ROGERSVILLE — A Sneedville man who was arrested by the Hawkins County Sheriff’s Office earlier this month on a DUI charge is now facing a felony charge for allegedly threatening the arresting officer and the officer’s wife, mother and grandmother.
Jacob Colby Trent, 26, 351 Maple Road, Sneedville, was arrested Aug. 7 about 3:30 a.m. after Deputy Jeremy Nash and Deputy Jason Montgomery found him parked on Pressmens Home Road asleep behind the wheel with a passenger.
After failing field sobriety tests, Trent was arrested for DUI and transported to the Hawkins County Rescue Squad station for a blood draw.
While en route to the rescue squad, Trent allegedly began yelling at Nash that he was being treated unfairly.
In the arrest affidavit, Nash quotes Trent as saying, “You’re just a (expletive) cop who won’t give a man a break. … You just wait until I see you in the public without your gun and your badge. I’ll (expletive) your world up.”
Upon arriving for his blood draw, Trent was reportedly cooperative, but while being driven by Nash to the jail he allegedly began making threats again.
Nash quotes Trent as saying, “(Expletive) your mother, wife and grandmother. … You will pay for taking me to jail. Just wait until my court date. You’ll regret your life.”

Idaho: booze blamed on crash when Tarin Mendoza failed to yield at intersection, striking car driven by David King, of Lake Tapps, Wa.

According to the Idaho State Police, on August 12, 2012, at approximately 1:42 am, Idaho State Police investigated a two vehicle crash on 2100 South and State Highway 46, near
Gooding.
Tarin Mendoza, 18, of Wendell was traveling east on 2100 South in a 1997 Plymouth Neon. David King, 32, of Lake Tapps, WA, was driving a 2011 Toyota Camry. Mendoza failed to yield to King.  David King was traveling on State Highway 46 when Mendoza collided with his vehicle in the intersection.
Both drivers were transported to North Canyon Medical Center where David was treated and released. Police report that alcohol is a factor in the crash. The northbound lanes on SH46 were blocked for approximatly two hours. The crash is still under investigation.

Family members of two motorists who were killed by a drunken, wrong-way driver reacted angrily and tearfully today when an Erie County judge refused their request to sentence the convicted driver to the maximum prison term.
Erie County Judge Michael F. Pietruszka sentenced Matthew Ruckdaschel to 3 1/2 to 10 1/2 years in prison.
As the first person to be convicted in Erie County of aggravated vehicular homicide, Ruckdaschel had faced a harsher sentence than earlier drunken drivers who left carnage in their wakes.
Ruckdaschel, 26, of Getzville, had faced a minimum prison sentence of one to three years and a maximum term of 8 to 25 years after pleading guilty in April to killing two men when he drove the wrong way on the inbound Kensington Expressway.
Last month, Anthony Thompson, the first person to be sentenced in Erie County for aggravated vehicular homicide, was sentenced by a different judge to five to 15 years in prison for his aggravated vehicular homicide conviction for a crash last year that killed one of his passengers, severely and permanently injured an off-duty Buffalo police officer, and injured

Alcohol and speed are suspected factors in a head-on crash that killed a 38-year-old woman in the city’s southwest early Sunday.
Calgary police say a 2001 Ford F150 pickup truck was heading north on Sarcee Trail S.W. approaching Bow Trail S.W. in the left-hand lane.
A 2009 Mercedes-Benz C63AMG sedan was heading west on Bow Trail S.W. heading toward Sarcee Trail S.W. in the middle lane when it T-boned the Ford on the passenger side in the intersection at around 3:15 a.m.
The pickup truck spun toward the northwest and struck a large power pole about 60 metres from the crash. Both occupants were ejected.
