Rosemary Lehmberg’s DWI arrest. You’ve seen what happened inside the jail,  now we’re getting a look at her actions along the roadway.

Dash camera video shows the Travis County District Attorney Rosemary Lehmberg  on the side off FM 620 swaying and stumbling while a witness describes her  reckless driving to deputies.

Deputy: “She went into oncoming traffic?”

Witness: “She did.”

As shown on this dash camera video, deputies escort Lehmberg to a paved lot  to perform a sobriety test.

Deputy: “How much did you have to drink?”

Lehmberg: “I had a couple drinks.”

Deputy: “What did you have?”

Lehmberg: “Vodka.”

Deputy: “Straight vodka? Vodka cranberry something like that?”

Lehmberg: “Vodka and soda.”

Lehmberg tells the deputy that she had those drinks at a friend’s house off  Enfield in Austin. Her story would later change at the jail.

Lehmberg from jail video released last Friday, “I went to a movie at Lakeway.  I had a couple glasses of wine at the movie. That’s all I had. I wasn’t driving  erratically. They pulled me over and it’s not true.”

Back to the dash camera video, Lehmberg gets ready to walk the line. She  makes several attempts, often losing her balance and having to lean on  deputies.

Please accept this as my Plea of Guilt to the Charge of Driving While Intoxicated, arising from my arrest on 4/12/13, for whatever level of offense is determined to be justified by the facts.

I enter this unconditional Plea without request for delay, without legal argument by counsel, without any plea bargain, and without any request for leniency or consideration of any type.

I am guilty of DWI and of acting unreasonably and the fault is all my own. I am deeply sorry for my actions.  I apologize to the citizens of Travis County and specifically to the dedicated officers and employees who had to deal with my violation and any disrespectful conduct after my arrest.

Further, I agree to appear, without delay, to enter this plea and I accept whatever assessment of jail time is deemed appropriate by the sentencing Court.

In addition, I agree to waive any right to consideration of probation and waive any right of appeal of my guilt or my punishment, whatever it may be.

AUSTIN  – Travis County deputies arrested District Attorney Rosemary Lehmberg, 63, on a charge of driving while intoxicated in North Travis County on Friday night.

According to the affidavit, a citizen called in Lehmberg’s Lexus around 10:45 p.m., saying she was driving in the bike lane for at least a mile on southbound FM 620. She also was seen weaving in out of of traffic. Lehmberg finally came to a stop in front of St. Lukes Church in 5600 block of FM 620.

The affidavit describes Lehmberg’s demeanor as both polite and excited, insulting and cocky. The smell of alcohol as moderate, and her eyes were bloodshot and watery. She also was described as disoriented with slurred speech. She lost her balance during the field sobriety test and started before the instructions to start.

Lehmberg said she had two vodka drinks earlier in the evening, as well as a prescribed medication.

Rosemary Lehmberg is a native of Taylor, Texas. She received a BA degree in Natural Sciences from the University of Texas at Austin and her Juris Doctor degree from St. Mary’s University School of Law.
She maintained a private law practice before joining the staff of the Travis County District Attorney in 1976.

Rosemary began her career with the District Attorney working with the Grand Jury and then as a trial attorney  in the 167th District Court, presided over by Judge Tom Blackwell. She later became chief of that court and  then the chief of the Trial Division.

 She has served as the chief of the Career Criminal, Major Crimes and Public Integrity Divisions.

In 1988, Rosemary became director of the Family Justice Division.  While director, she was a founder of the Travis County Children’s Advocacy Center, now the Center for Child Protection, which opened its new campus in September, 2008.  The Center provides state-of-the-art, collaborative investigations of child abuse cases in a child-friendly environment.  During her tenure with the Family Justice Division, the Austin Chronicle named Rosemary the Best Lawyer for Children’s Issues.

 Rosemary served as First Assistant District Attorney from 1997 until 2009, when she was elected District Attorney.   She took office in January, 2009, the first woman District Attorney in Travis County history.

A prosecutor in the Jefferson County District Attorney’s Office has resigned after being accused of driving with a blood alcohol content at four times the legal limit.
Sheriff’s deputies say they stopped 37 year old Aaron Carr in the city of Watertown Tuesday night while they were investigating a reckless driver complaint.
Deputies say he had a blood alcohol content of .32 percent.
The legal limit is .08 percent.

A Pawling village justice who was arrested for a second time on a driving while intoxicated charge has entered a guilty plea.
Robert Apple, 56, was charged with a felony during the summer in Carmel. The DWI charge came less than three years after a 2009 conviction for the same offense. Apple was censured by a state Commission on Judicial Conduct after his first arrest.

SAN ANTONIO – A couple whose daughter was run down and killed by a drunk driver back in 2009 is devastated to have waited this long for a trial they have learned will never happen.
The charges for the driver, 27-year-old Chad William Schreiber, have been reduced from intoxication manslaughter to driving while intoxicated. A plea agreement was reached in the case on Friday when Schreiber pleaded no contest to the DWI misdemeanor charge, which carries a maximum sentence of six months jail time. He is scheduled to be sentenced in 30 days.

A soon-to-be lawyer who was charged with intoxication manslaughter four years ago after he ran over a motorcyclist while driving home from a St. Mary’s law school function instead pleaded no contest Friday to misdemeanor driving while intoxicated.
Although a blood test showed Chad William Schreiber, 27, to have an alcohol level of .13 — just more than 11/2 times the legal limit of .08 — police who responded to the scene were not sure that his intoxication was the cause of the wreck.
