GEORGETOWN, DEL. —2013-09-20— A 26-year-old man has pleaded guilty to driving under the influence in a fatal accident on the Fourth of July near Dewey Beach.

Matthew T. O’Connor, of Washington, D.C., entered his plea earlier this month in Justice of the Peace Court in Georgetown, was fined and placed in an offender program.

As part of the First Offense Election program, the defendant admits guilt and has his or her license or driving privilege revoked temporarily, according to the Delaware Department of Motor Vehicles website. The website and Delaware law state that there are multiple conditions to be considered for the program. One of them is that the driver could not have caused injury to someone else in an accident.

However, in this incident, Roy E. Love, 79, was killed and Helene L. Love, 75, was admitted to the hospital in critical condition, according to a Delaware State Police news release from July 5.

Roy and Helene Love, of just south of Dewey Beach, had been crossing Del. 1 near their home when they stepped into the left lane of southbound traffic shortly after 9:30 p.m.  and were hit by O’Connor’s 2005 Lincoln Aviator SUV, state police said. ….MORE
