01/13/2016 — The U.S. Marshals Service has confirmed the man, 61-year-old Abraham Spotted Elk, who punched and drug a Montana Highway Patrol trooper after a traffic stop was on supervised release for homicide.

He was originally arrested for the 1986 killing of a man in Lame Deer.

The U.S. Marshals put him under arrest while he was in the hospital. According to Capt. Keith Edgell with Montana Highway Patrol, Spotted Elk was supposed to be released from the hospital Monday morning but now will be spending more time there for unknown reasons.

Spotted Elk’s chase with MHP ended in the suspect driving through a concrete barrier down an embankment on the S 27th St. overpass.

The trooper involved was not injured.

Highway Patrol is working with the County Attorney’s office to file charges against Spotted Elk, including felony assault of a peace officer.

ORIGINAL STORY:

A man was sent to the hospital, and will be spending the first part of the new year in jail after a car chase tonight.

It started when a Montana Highway Patrol trooper pulled over on a car on 1st Ave. because registration was not properly displayed. Sgt. Phillip Freed with MHP said when the trooper got to the drivers window, he saw a large bag of what they assume was methamphetamine. The trooper asked to see the bag, the driver pulled it out and that is when the driver punched the trooper in the head. The driver then started to drive off, dragging the trooper for 10-15 feet.

Highway Patrol chased the driver until he drove through a concrete barrier and down an embankment towards I-90 on the S 27th St. overpass.

Sgt. Freed says the man was taken to the hospital with a foot injury.

The trooper did not sustain any injuries.

Sgt. Freed says they believe alcohol was a factor in the crash. The man was also currently on federal probation.   ….MORE
