DWI arrest Leandra’s Law Guilderland Police 070415

Guilderland Police report: On Friday, July 3rd, 2015 at 6:21 p.m., Officers from the Guilderland Police Department initiated a vehicle stop on a male subject who was operating an ATV (All Terrain Vehicle) on Morningside Drive, while his 16 month baby was sitting in front of his lap, between himself and the gas tank. The operator Gerard Richard, is 39 years old and resides at 1 Veeder Lane, in the Town of Guilderland. Neither the operator or infant were wearing a helmet. Following an investigation, Richard was found to be intoxicated. Following a breathalyzer test, Richard was found to have a .12% BAC. 

Gerard Richard was charged with the following charges:

Aggravated DWI a Class ‘E’ Felony (Leandra’s Law)
Endangering the Welfare of a Child a Class ‘A’ misdemeanor
Unregistered ATV Traffic Infraction
Unlawful Operation of an ATV on a Highway
Operating an ATV without a Helmet

Richard was released on his own recognizant and is to reappear in the Town of Guilderland Court on July 9th at 5:30pm.
