New York: State Police round up DWI drivers in first days of New Year; includes Trooper Randy Weaver in no-go in the snow


New York State Trooper Randy Weaver Charged with DWI in no-go in snow incident
On January 1, 2013 at 10:00 p.m., a Trooper from SP Indian Lake was dispatched to the report of a possible PIAA snowmobile accident on ST-30 in the town of Indian Lake. Investigation at the scene revealed that a snowmobile owned and operated by Randy J. Weaver, age 31, an off-duty Trooper at SP Indian Lake, had become stuck in a snow-filled ditch by the roadside. Upon interview, it was determined that Weaver appeared intoxicated. He was administered Standardized Field Sobriety tests and subsequently arrested for Operating a Snowmobile Under the Influence of Alcohol, a violation of Section 25.24 of the NY Parks, Recreation and Historic Preservation Laws. He is scheduled to appear at the Indian Lake Town Court on January 8, 2013 at 6:30 p.m. He was suspended without pay pending the investigation of his conduct.

Conklin, NY – January 7, 2013) On January 5, 2013, SP Binghamton Troopers arrested Keith M. Rowe, 45, of Hallstead, PA for Driving While Intoxicated with a BAC result of .14 %. The arrest resulted from a traffic stop on State Route 7 in Conklin, NY. Mr. Rowe was issued tickets returnable to the Town of Conklin Court on January 22, 2013.

(Davenport, NY – January 7, 2013) On January 5, 2013, State Police at Oneonta arrested Ashley L. Briggs, 24, of Meredith, NY for Driving While Intoxicated with a BAC result of .13%. The arrest resulted from a traffic stop on State Route 23 in Davenport, NY. Ms. Briggs was issued tickets returnable to the Town of Davenport Court on January 13, 2013.

(Oneonta, NY – January 4, 2013) On January 3, 2012, SP Oneonta Troopers arrested Kari O. Hall, 26, of Delhi, NY, for Driving While Intoxicated with a BAC of 0.13%. The arrest was the result of a traffic stop in Oneonta, NY. Hall was issued an Appearance Ticket returnable to the Town of Oneonta Court on January 8, 2013.

On January 5, 2013, the New York State Police out of Mayfield arrested THEODORE C. MARCAIS, age 25, of Gloversville, NY for Driving While Intoxicated and Criminal Possession of Marijuana in the 5th Degree.

At approximately 4:07am the State Police conducted a vehicle and traffic stop of MARCAIS’ vehicle on Park St. in the City of Gloversville. Subsequent to the stop MARCAIS was found to be intoxicated and in possession of approximately 42 grams of marijuana.

MARCAIS was processed without incident at SP Mayfield and released on Appearance Tickets returnable to the City of Gloversville Court on 01/29/13 at 9am.

State Police Arrest Jordan T. Hughes for DWI
Clarence — On January 6, 2013, Clarence State Police Members arrested Jordan T. Hughes, 32, of Lockport, NY for Driving While Intoxicated. Hughes was stopped for speeding while traveling north on Shimerville Rd. in the Town of Clarence. Investigation at the scene revealed that Hughes had been drinking and under the influence of alcohol. He was transported to the SP Clarence Station where he was processed and refused a breath test. Hughes was released to appear in the Town of Clarence Court on 1/17/13. On

Law Charged With Breaking Law Regarding Driving While Intoxicated

1/1/13 at approximately 3:03 PM SP Machias troopers were dispatched to a rollover accident on Rawson Rd in the Town of Lyndon. Trooper Timothy Pompeo responded and discovered that Jon W. Law, age 39, of Friendship, NY had lost control of and rolled his pickup truck. During his investigation at the scene Trooper Pompeo determined that Law was intoxicated. Trooper Pompeo arrested Law for DWI. During processing it was determined that Law had a blood alcohol content of .26%. Law also had a prior DWI conviction in the past ten years. In addition to the charge of aggravated DWI (felony), Law was charged with vehicle and traffic law violations relating to the rollover crash. Law will answer the charges in the Town of Lyndon Court next month.

Ditch-Driver Busted on DWI Charge

On January 1st, 2013, Trooper KEITH MULAWKA arrested JACOB BURROUGHS, 21, of Steamburg, for Driving While Intoxicated. Trooper MULAWKA patrolled to West Perimeter Road in Cold Spring for a report of a one-car motor vehicle accident. Investigation revealed that BURROUGHS exited the east side of the roadway, and came to rest in a ditch. BURROUGHS was arrested after failing several field sobriety tests, and transported to the State Police barracks in Jamestown where he provided a breath sample of .14. BURROUGHS was then processed, issued tickets returnable to the Town of Cold Spring Court, and released to a sober individual. BURROUGHS was not injured in the accident.

State Police make DWI arrests in Newstead and Boston

Cops Were on a Roll

On January 3, 2013 at approximately 12:23 P.M., Trooper Wesolek, stopped a 2003, green Ford Taurus, on Main Road, in the Town of Newstead for an expired inspection. Upon approaching the vehicle, the driver was identified as David A. Roll, age 44, of Depew N.Y., who admitted to having an alcoholic beverage in the morning. As a result, SFST’s were performed on Roll, which resulted in his arrest for Driving While Intoxicated. Roll was then transported to SP Clarence where he submitted to a chemical test which resulted in a BAC of .25%, which resulted in an Aggravated DWI charge. Roll was processed and later released to a family member and was scheduled to appear before the Town of Clarence Court on 01/16/13, at 7:00 P.M.

At 1:52 P.M., Trooper Michalski, of SP Boston stopped a red F250, pickup on Hermanhill Rd., in the Town of Boston for an expired inspection sticker. Upon approaching the vehicle, the driver was identified as Robert Fenski, age 22, of Orchard Park, N.Y., who appeared intoxicated. As a result, Fenski was given Standardized Field Sobriety Tests which resulted in his arrest for Driving while intoxicated. Additionally, Fenski was found to be in violation of unlawful possession of Marihuana and was transported to SP Boston where he submitted to a Blood Alcohol Chemical test, which resulted in a .10% BAC. Fenski was later released to a third party and was scheduled to appear before the Town of Boston Court on 1/28/13, at 6:00 P.M.

On 01/05/13 while on patrol SP Lyons Troopers observe a vehicle fail to keep right and move from lane unsafely on Barnes Road in the Town of Macedon. A V & T stop was initiated and investigation led to the arrest of Matthew K Carkner, age 19, from 3200 Maple Ave Palmyra, NY for driving while intoxicated (BAC .23%), aggravated DWI (BAC .18 or more), fail to keep right on 2 lane road, and moving from lane unsafely. Registered owner of vehicle responds to retrieve vehicle. Carkner issued appearance tickets returnable to the Town of Macedon Court 01/22/13 and released to the care of his father.

Wayne D. Leitch charged with DWI
On 01/04/13 SP Auburn Trooper observes a vehicle fail to stop for a stop sign at State Route 90 and Creek Road in the Town of Locke. Investigation led to the arrest of driver Wayne D Leitch, age 53, from 3781 Lane Road Locke, NY for failure to stop at a stop sign, consumption of an alcoholic beverage in a motor vehicle, refusal to submit to a breath test and felony driving while intoxicated. Vehicle was turned over to Leitch’s wife who responded to scene and Leitch was arraigned in the Town of Locke Court and remanded to the Cayuga County Jail on $2,500 cash or $5,000 bond and is to reappear in Town of Locke Court 01/09/13.

SP Rochester DWI arrest
On January 5, 2013, Tpr. Patrick Hargather while on patrol on interstate 490 eastbound in the city stopped a vehicle being operated by Sean M. Dibella, 28 of 1784 Norton Street , Rochester. During the interview of him a strong odor of an alcoholic beverage was emanating from him. He was given roadside field sobriety tests which were failed and was transported to SP Rochester where he provided a breath sample with a BAC of .17%. Mr. Dibella was issued utt’s and is to appear in city court on 1/24/13 at 9:30am.

Hammondsport Woman Arrested for Aggravated DWI Under Leandra’s Law
On January 1st, Bath State Police responded to a one car motor vehicle accident on VanAmburg Road. Following an investigation, April M. Zyla, 35, of Hammondsport was arrested for Aggravated Driving While Intoxicated under Leandra’s Law, for having her 2-year old son in the vehicle. She was arraigned in the Town of Urbana Court and remanded to the Steuben County Jail in lieu of $2000 cash bail or $4000 property bond.

Breesport Man Arrested for DWI
On January 1st, Horseheads State Police arrested Tyler J. Howard, 21, of Breesport for Driving While Intoxicated with a BAC of .11% and speeding (67/55) following a traffic stop. He was arraigned and remanded to the Chemung County Court in lieu of $2000 cash bail or $4000 property bond.

Dundee Man Arrested for Driving While Intoxicated
On January 1st, Bath State Police arrested Mark W. Dickerson, 45, of Dundee for Driving While Intoxicated following a traffic stop on I-86. He was arraigned in Bath Town Court and remanded to the Steuben County Jail in lieu of $200 cash bail or $400 property bond.

Urbana Man Arrested for Driving While Intoxicated
On December 31st, Bath State Police were dispatched by Steuben County 911 to a report of a car in a ditch on Hutches Road in the Town of Bath. Following an investigation, Michael K. Bartholomay, 60, of Urbana was arrested for Driving While Intoxicated with a BAC of .15%. He is scheduled to appear in Bath Town Court on January 16, 2013.

Pine Valley Man Arrested for DWI
On December 30th, Painted Post State Police arrested Jerry V. Austin, 56, of Pine Valley for Driving While Intoxicated with a BAC of .08% following a traffic stop. He is scheduled to appear in the Town of Corning Court on January 7, 2013.

Painted Post Woman Arrested for DWI
On December 30th, Wayland State Police were dispatched to a motor vehicle stuck in a snow bank on I-86. Following an investigation, Jennifer R. Phillips, 40, of Painted Post was arrested for Driving While Intoxicated. She was arraigned in the Town of Fremont Court and remanded to the Steuben County Jail in lieu of $1000 cash bail or $2000 property bond.

DWI Arrests Made During Sobriety Checkpoint
Horseheads State Police arrested Derrick W. Baker, 26, of Woodhull for Driving While Intoxicated with a BAC of .12% following a Sobriety checkpoint on December 28th. He is scheduled to appear in the City of Corning Court on January 8, 2013.
Big Flats State Police arrested Bryan T. White, 41, of Painted Post for Driving While Intoxicated with a BAC of .11% following a Sobriety checkpoint on December 28th. He is scheduled to appear in the City of Corning Court on January 8, 2013.

State Police Charge Darryl K. Spotford with DWI
On January 1st, 2013 on the innerloop in the city, State Police arrested Darryl K. Spotford, 29 of Rochester for driving while intoxicated subsequent to a traffic stop. Spotford refused to provide a breath sample and will appear in city court on a later date.

Lazzar’s speed gets her notice by State Police; results in DWI arrest 
On January 1, 2013 while on patrol, SP Williamson Troopers observed a vehicle traveling eastbound on State Route 104 in the Town of Williamson at a high rate of speed.
A traffic stop and investigation led to the arrest of Judith C. Lazzar, 35, of Sodus Shores Road in Sodus, NY. Lazzar was charged with DWI (BAC .13%) and speeding in zone.
Lazzar was issued tickets returnable to the Town of Williamson Court on February 6, 2013 and released to a family friend.

State Police Arrest Shine in the Light of the Moon
On January 1, 2013 while on patrol, SP Wolcott Troopers initiate a traffic stop on State Route 38 in the City of Auburn for speeding.
Further investigation led to the arrest of Patricia A Shine, 44, of Fitch Ave, Auburn NY.
Shine was arrested for DWI (BAC .15%) and speed in zone.Shine was issued appearance tickets returnable to the City of Auburn Court on January 4, 2013 and released to a family member.

SP Auburn make DWI arrest
On December 31, 2012 while on patrol, SP Auburn Troopers observe a vehicle westbound on the arterial turn onto Columbus Street in the City of Auburn.  The vehicle was stopped and an investigation led to the arrest of James C. Dean, 35, of Dresserville Road in Moravia, for drinking alcohol in a motor vehicle on the highway, aggravated unlicensed operation of a motor vehicle 1st, license restriction violation, and DWI (BAC.16%).
Dean was arraigned in the Town of Fleming court and remanded to the Cayuga County Jail in lieu of $1,000 cash bail.

SP Geneseo Makes DWI Arrest
On December 30, 2012 at approximately 9:20 PM, the New York State Police in Geneseo stopped a vehicle on ST 63 in the town of Groveland for having a headlight out. During the inerview of the operator, Dana R. Whitehouse, Age 51, Tallman Street, Mount Morris, NY a strong odor of an alcoholic beverage was detected. Mr. Whitehouse performed standardized field sobriety tests in which he failed. He was arrested for DWI and transported to SP Geneseo where he registered a .17% BAC. He was charged with felony DWI since he had a prior conviction for DWI in 2005. He was arraigned and remanded to the Livingston County Jail in lieu of $2,500 cash or $5,000 bond.

New York State Police Issue 33,000 tickets and Make 538 DUI Arrests

The national impaired driving enforcement campaign began Friday, December 14, 2012 and continued through Tuesday, January 1, 2013.  More than 20,000 police agencies nationwide participated.
From Friday, December 14, 2012 through Tuesday, January 1, 2013, the New York State Police issued more than 33,000 tickets and arrested 538 people for DWI statewide.
During the period, the New York State Police held 29 sobriety checkpoints, 10 saturation details, 12 underage drinking and “sales to minors” details, and 41 additional dedicated local DWI patrols.  Saturation details consist of multiple roving units that target a specific area of focus. In addition to the checkpoints and patrols, 12 underage drinking initiative details checked 14 bars and 120 retail establishments across the state. State Police made 22 arrests for providing alcohol to minors and 12 penal law violations.
It is a massive effort supported largely through grants from the Governor’s Traffic Safety Committee, aimed at preventing tragedies during the Holiday Season.
