Texas: Dad indicted for murder of drunk driver who killed his two sons — no need to worry about probation for the man who killed his kids

ALVIN, Texas  -Months after David Barajas buried his children who died as the result of a vehicle accident, he has been charged in the shooting death of the man who drove the car that struck the two boys.
David Barajas, 31, was charged with murder on Monday and a bond of $450,000 has been set for him.
Barajas’ sons, David and Caleb, were helping their father push his disabled Ford F-250 pickup truck along County Road 144 near County Road 712C in Brazoria County after 11 p.m. on Dec. 7, 2012 when the car, driven by Jose Banda, crashed into the rear part of the truck. Young David was killed and Caleb later died at a hospital.
Banda, 21, was taken by Life Flight medical helicopter to Memorial Hermann Hospital – Texas Medical Center where he later died. Medical staff determined Banda was intoxicated when the crash took place.
