California: Ross Valley Fire Captain Rick Marshall’s attorney says client has been a “hero for decades”; but he was out to kill and loaded on the way to work!

A Ross Valley fire captain who was injured in an alleged DUI crash in Novato was on his way to work that morning with an alcohol level nearly twice the legal limit for driving, authorities said.
Rick Marshall, a 46-year-old Novato resident, is scheduled to be arraigned Monday morning in Marin Superior Court. He is charged with driving while intoxicated and driving with a blood-alcohol level in excess of .15 percent, said Deputy District Attorney Kevin O’Hara.
The legal limit for driving is .08 percent. Marshall could face up to a year in jail on the misdemeanor charges, but he has no criminal record in Marin and could be placed on probation.
Marshall will plead not guilty, said defense attorney David Vogelstein.
“I think it’s a sad situation,” said Vogelstein, who is representing Marshall with co-counsel Gary Kauffman. “He’s severely injured and we’re going to deal with the case and move forward. … This is a man who was a hero for decades.”
