Carmel Police report that on Sunday, March 16, 2014 at 11:41pm, James S. Irsay (54 years old) was stopped in the 13000 block of Horseferry Road, Carmel, IN for driving at a slow rate of speed, stopping in the roadway and failure to signal turn.

During the course of the investigation, Irsay subsequently failed several roadside field sobriety tests and was arrested for Operating While Intoxicated (I.C. 9-30-5-2(A) /A-Misdemeanor).

During the inventory of Irsay’s vehicle, multiple prescription drugs were discovered in pill bottles. These Schedule IV prescription drugs were not associated with any prescription bottles found in the vehicle. He was also charged with Possession of Controlled Substance

“Discipline for a second or subsequent offense is likely to be a suspension, the duration of which may escalate for repeat offenses,” the league’s substances-of-abuse policy states.

Smith’s arrest Friday marked the fifth DUI-related arrested involving a 49ers player in the past three years.
