Montgomery judge draws line in the sand on alcohol liability

In a bold opinion, Montgomery County Circuit Court Judge Eric M. Johnson has taken a stand on the side of good.
Last month, Johnson issued an opinion in a civil lawsuit against Dogfish Head Alehouse in Gaithersburg that is seeking $3.25 million for the family of 10-year-old Jazimen Warr. Jazimen was killed on Interstate 270 in 2008 by a man who was served drinks at Dogfish Head. According to police reports, the driver who hit the Jeep in which Jazimen was riding had been served several beers and a shot before he got into his Land Rover and drove between 88 and 98 mph on I-270….MORE

Sam’s Dogfish Head Alehouse sold served Eaton the following: 

Maryland State Police searched for him, tracing his activities before the wreck to the Dogfish Head Alehouse in Gaithersburg, where he racked up two bar tabs totaling $107. Included were 17 bottles of Corona, 2 Lemon Drops and 1 Cuervo Gold. Police learned that he might have bought some of the drinks for others. At 3:30 the next day, Eaton turned himself in at the state police barracks in Rockville, police said.
