Pinellas County, Florida (Feb. 28, 2011) — According to police  investigators, on Saturday Feb. 26, 2011 at about 1:40 am, Pinellas County Sheriff’s Deputy Karl Gwynne was northbound in the center lane of US19 stopped at a red light at Tampa Road, when he was rear ended by a 1996 Toyota Avalon driven by 45 year-old Herbert Hugh Andrew McClellan III.
Police report that Deputy Gwynne complained of neck injuries, but refused treatment.
McClellan was extricated from the vehicle and was transported to Mease Countryside for treatment of non-life threatening injuries.
Following release from the hospital, McClellan was transported to Central Breath Testing for Standardized Field Sobriety Test and a breath test. Investigators say his Blood Alcohol Level was .183.
Deputies also located open beer cans, a small amount marijuana, and a prescription medication in the suspect’s vehicle.
Police say that Deputy Gwynne’s cruiser sustained moderate damage. McClellan’s vehicle sustained major damage. Deputy Gwynne is a 6-year veteran of the department.
McClellan was arrested for the careless driving, no insurance, seatbelt violation, open container and an administrative citation for possession of a controlled substance, as well as DUI, according to police press releases and jail records, and transported to the Pinellas County Jail.
