BOISE — Republican Senate Caucus Chairman John McGee choked back tears when he pleaded guilty Friday in court to the misdemeanor offense of operating a vehicle under the influence of alcohol. McGee also issued an apology and his attorney offered a possible explanation for the senator’s actions when he was discovered in the early morning hours of Father’s Day.
Both parties recommended that the other felony count against McGee, 38, be dropped. He was charged with operating a vehicle without the owner’s consent causing more than $1,000 in damage. McGee has already paid for the damage he caused and apologized.
McGee’s attorney, Scott McKay, also explained to the court that McGee’s odd behavior, beyond the fact that he had consumed alcohol— his BAC measured at 0.15, nearly twice the legal limit — was likely the result of a concussion that he sustained when he fell during his walk from the golf course to the neighborhood where his parents live.
“Sen. McGee has been examined by a respected neurologist who has concluded that as a result of this fall, he likely sustained a concussion prior to the events leading to his arrest,” McKay said in a statement released to the press…..MORE
