A Royal Oak woman accused of causing a fatal accident on Dequindre in January has waived her right to a preliminary exam, sending the matter directly to Macomb County Circuit Court. Accompanied by attorney D. Todd Williams, Kelley Marie Nagle, 20, appeared briefly before Judge Stephen Sierawski in 41-A District Court March 14 to confirm her desire to forgo the prelim, which had been adjourned from Jan. 31.
The hearing typically lays out a portion of the prosecution’s evidence so the district court judge can determine whether there’s enough merit to bind the case over to circuit court for trial.
According to Sterling Heights police, Nagle was driving southbound on Dequindre, just south of 19 Mile, in her Trailblazer at around 12:18 a.m. Jan. 16 when she attempted to pass a Mazda sedan. Her SUV collided head-on with a Ford Ranger pickup truck that had been traveling north on Dequindre, and then struck the Mazda.
The Ranger’s driver, later identified as Annette Eileen Evans, 53, of Richmond, was transported to Beaumont Hospital, Troy, where she was later pronounced dead. Nagle and the Mazda’s driver escaped without injury…..MORE
