New Jersey: detective’s romp down ski trail in his jeep, injured his child; rewarded with “courtesy arrest” for DWI

The driver in an off-road crash at Mountain Creek in which he, his wife and 6-year-old son were injured, was charged Friday with driving while intoxicated, the Sussex County Prosecutor’s Office said.

The DWI summons was issued more than two weeks after Michael Fertitta, 39, of Vernon, was charged with endangering the welfare of a child in the second degree and two counts of assault by auto in the fourth degree stemming from the May 4 crash.

Fertitta, a detective with the Passaic County Prosecutor’s Office, allegedly had a blood alcohol content of .17 percent, just over twice the legal standard for impairment in New Jersey, which is .08 percent.

His attorney, James Pomaco, received the DWI summons on Friday, according to Sussex County Assistant Prosecutor Francis Koch.
