New Jersey: Marie Briamonte charged with DWI death by auto for killing Maninder Singh

Marie Briamonte charged with DWI fatal Bergen Co NJ 121214Bergen County Prosecutor John L. Molinelli announced the arrest of 58 year old, MARIE BRIAMONTE, of Paramus, New Jersey, on charges of Death by Auto. The arrest is the result of an investigation conducted by members of the Bergen County Prosecutor’s Office, Fatal Accident Investigation Unit under the direction of Chief Carmen MARTINO and the Elmwood Park Police Department under the direction of Chief Michael FOLIGNO.

On Tuesday, December 9, 2014, at approximately 10:50 p.m., the Elmwood Park Police Department received a report of a motor vehicle collision with a pedestrian who had been struck in the area of the intersection of Route 46 West and Bank Street in Elmwood Park. Officers responding to the scene determined that Marie BRIAMONTE, who was operating a 2003 Toyota Camry, had struck MANINDER SINGH, a 48 year old North Plainfield, New Jersey man, who had crossed the highway near the intersection. As a result of injuries suffered during the collision, Mr. SINGH was transported to St. Joseph’s Medical Center where he was pronounced dead. Officers at the scene made observations that led them to believe that Ms. BRIAMONTE was driving while intoxicated.

As a result of a cooperative investigation conducted by members of Bergen County Prosecutor’s Office, Fatal Accident Investigation Unit and the Elmwood Park Police Department, it was determined that at approximately 10:50 p.m., on December 9, 2014, Ms. BRIAMONTE was driving west on Route 46 when she struck Mr. SINGH, who was a pedestrian crossing the divided highway. The location of the incident was determined to be within 1,000 feet of the Gantner Avenue School in Elmwood Park. A blood sample was taken from Ms. BRIAMONTE, who appeared to be intoxicated at the time of the collision, and will be submitted for toxicological examination.

MARIE BRIAMONTE was charged with one count of violating N.J.S.A. 2C:11-5, Death by Auto while driving in violation of R.S. 39:4-50 (DWI) within 1000 feet of the Gantner Avenue School. The investigation is ongoing and Ms. BRIAMONTE was also issued summonses for motor vehicle violations including Driving while Intoxicated and Reckless Driving. Ms. BRIAMONTE was released on bail set at $150,000 with a 10% cash option by the Honorable Anthony Gallina, Elmwood Park Municipal Court Judge. Her first appearance in Elmwood Park Municipal Court has been scheduled for 1:00 p.m., on December 16, 2014.

Prosecutor Molinelli states that these charges are merely accusations and that the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt and would also like to thank the Elmwood Park Police Department for their assistance in this investigation.

CBS New York reports Singh was attempting to summon a police officer for a customer at the gas station where he worked was refusing to pay…the customer fled as he crossed highway to get the cops…
