ALBANY — The city police officer charged in December with driving while intoxicated after he allegedly was found dozing in his car on Interstate 787 has regained his right to drive because the arresting officer failed to appear at a Department of Motor Vehicles hearing, an agency spokesman said.  The criminal case against Officer Brian Lutz is pending in Menands Village Court, but in a separate civil proceeding overseen by the DMV the temporary suspension of Lutz’s drivers license has been “terminated,” DMV spokesman Nick Cantiello said….MORE
