After Shawn Michael Ahern admitted Tuesday that he was driving drunk when he hit and fatally injured pedestrian Grace Allen in Fairport, Allen’s daughter, Roberta Allen, said she was disappointed by the case’s outcome.
Although Ahern was charged with the felonies of first-degree vehicular manslaughter and driving while intoxicated, the prosecution required only a guilty plea to DWI — and not manslaughter — because of the difficulty in proving that Ahern’s intoxication directly caused Allen’s death, a legal requirement for a manslaughter conviction. ….MORE
