NEW YORK: State Police report DWI arrest of pizza delivery driver John B. Smith following an alleged hit and run of a mailbox at twice the legal limit

According to the New York State Police, on October 16, 2021, the New York State Police in Sand Lake arrested 35-year-old John B. Smith of Nassau for Driving While Intoxicated, a misdemeanor. State Police responded to a report of a hit and run property damage accident on West Sand Lake Road in North Greenbush late Saturday afternoon after a driver struck a mailbox and left the scene.

State Police were provided the vehicle information by a witness who saw the accident and was able to get the offending vehicle’s license plate.

Troopers located Smith at his place of employment where he arrived to meet them after completing pizza deliveries for the local restaurant. While speaking with Smith, the Trooper could smell the odor of alcohol coming from his breath. Smith was administered roadside sobriety tests, which he failed, and was taken into custody.

Smith was transported to SP Sand Lake where he provided a breath sample of .17% B.A.C. He was processed and released on an appearance ticket for North Greenbush Town Court on November 2, 2021.

Felony driving DWI rap for Katherine A. O’Brien

New York State Police say that on October 16, 2021, Troopers out of SP Warsaw arrested Katherine A. O’Brien, 28, of Pavilion, NY, for felony Driving While Intoxicated-Previous Conviction Within Ten Years. 

Troopers responded to a motor vehicle accident on Saltvale Road, in the town of Warsaw.  During the interview with operator O’Brien, she was exhibiting signs of impairment.  Troopers determined O’Brien had been operating a vehicle while in an impaired condition.  O’Brien had failed standardized field sobriety tests.  She was arrested, transported, and processed at SP Warsaw, where a chemical breath test revealed a 0.17% BAC.  O’Brien was arraigned at the town of Warsaw Court and released on her own recognizance.  O’Brien is to appear at the town of Warsaw Court at a later date.

Hand over the limit, reports New York State Police

On October 16, 2021, the New York State Police say that Olean Troopers arrested Anthony M. Hand, 40, of Friendship, NY for Driving While Intoxicated.

During a traffic stop on I-86 in the city of Salamanca, Troopers observed the operator, Hand exhibiting obvious signs of intoxication and determined he had been operating a motor vehicle while in an intoxicated condition. He failed standardized field sobriety tests at the scene.  Hand was then arrested and transported to SP Olean, where a chemical breath test revealed him to have a 0.11% BAC.

Hand was released with appearance tickets for Salamanca City Court, where he is due to appear next month.
