NEW YORK: State Police report DWI arrests for July 8, 2019

NEW YORK STATE POLICE REPORT THE FOLLOWING ARRESTS:

New York State Police report that on July 5th, 2019, Troopers out of State Police at Jamestown arrested Sharon Ray, 46, of Salamanca, for Driving While Intoxicated. 

Ray was pulled over on I-86 in Steamburg for traffic violations and placed under arrest after failing several SFSTs.  Ray was transported to SP Jamestown where she provided a breath sample of .11.  Ray was then processed, issued tickets and released.  Ray is scheduled to appear in the town of Cold Spring Court on a later date.

On July 4th, 2019, Troopers out of New York State Police Jamestown arrested Derek Gramling, 29, of Cumming, Georgia and Steven Bickis, 36, of Madison, Indiana, for a total of six counts of Criminal Possession of a Controlled Substance 7th Degree and two counts of Unlawful Possession of Marijuana.  Gramling was also charged with Criminal Possession of a Controlled Substance 4th Degree. 

Bickis was pulled over for speeding on Route 76 in Sherman and while speaking to the occupants, the Troopers smelled marijuana emanating from inside the vehicle.  A search of the occupants and vehicle revealed the following items: psychedelic mushrooms, hashish, liquid marijuana in an e-cigarette pen, LSD, multiple controlled pills for which neither occupant had a prescription, marijuana vegetation, and a pipe containing marijuana residue.  Gramling and Bickis were placed under arrest, processed at SP Jamestown and transported to the Chautauqua County Jail, pending arraignment.

According to the New York State Police, on June 30, 2019, SP Machias Troopers arrested Julie A. Holland, 51, of Machias, NY for Driving While Intoxicated and Refusal to Take a Breath Test.

While investigating a report of a vehicle striking ducks on North Junction Road in the town of Machias, Holland, identified as the driver, was exhibiting obvious signs of intoxication. Troopers determined she had been operating a motor vehicle in an intoxicated condition. She refused to perform standardized field sobriety tests at the scene. Holland was then arrested and transported to SP Machias, where she refused a chemical breath test.

Holland was arraigned in Machias Town Court, where she was released on her own recognizance. She is due to reappear in that court later this month.

Troopers out of SP Jamestown arrested Hannah Taylor, 20, of Cattaraugus, for Unlawful Possession of Marijuana. 

Taylor was pulled over for using her cell phone on Main Street in Randolph and while speaking to Taylor, the Troopers smelled marijuana emanating from inside the vehicle.  A search of Taylor and her vehicle revealed a bag of marijuana and two smoking devices containing marijuana residue.  Hannah was issued an appearance ticket and a traffic ticket and is scheduled to appear in the town of Randolph Court later in the month.

On July 4, 2019, at approximately 8:30 p.m., New York State Police at Endwell arrested Joseph M. Newfrock, age 21 of Union, NY for the felonies of Criminal Possession of a Firearm and the misdemeanors of Criminal Obstruction of Breathing, Criminal Mischief in the fourth degree, Assault in the third degree and Menacing in the second degree.  He was also charged with the misdemeanor of Driving While Ability Impaired by Drugs.

A trooper was dispatched to a domestic dispute at a residence on Columbia Drive in the town of Union.  A victim told the trooper that after an argument over taking the victim’s car, Newfrock threatened the victim with an unregistered gun, struck the victim with the butt of the gun and choked the victim before getting into the victim’s vehicle and leaving the area.  

A short time later, another trooper was dispatched to an accident involving multiple parked vehicles on Alexander Street in the town of Union.  The trooper discovered that the accident was caused by Newfrock.  Troopers were assisted on Alexander Street by deputies from the Broome County Sheriff’s Department. Newfrock was transported to Wilson Hospital for head injuries.  He was issued appearance tickets returnable to the town of Union court on July 16, 2019. 

Troop C Driving While Intoxicated and Driving While Ability Impaired by Drugs arrests June 29 to June 4, 2019:

On June 29, 2019 at approximately 4:29 a.m., New York State Police at Endwell arrested Randy L. Mills, age 34 of Endicott, NY for the misdemeanor of Driving While Intoxicated. Troopers and officers from the Village of Johnson City Police Department were dispatched to a fight of several intoxicated individuals at Walmart in the village of Johnson City.  Mills was one of the people involved in the disturbance, he entered his vehicle and began to drive through the parking lot.  A trooper stopped Mills in the parking lot and found Mills to be impaired.  After an investigation, Mills was arrested.  His reportable B.A.C. was .16%.  He was later released on appearance tickets to the village of Johnson City court on July 10, 2019, then turned over to a sober third. Party. 

On June 29, 2019, at approximately 3:47 p.m., New York State Police at Owego arrested Gregory D. Drake, age 42 of Painted Post, NY for the felony of Driving While Intoxicated (with a previous conviction within 10 years).  He was also issued tickets for Refusal to Submit to a Breath Test, Consumption of Alcoholic Beverage/Possession of Open Container and Threw/Deposited Refuse on Highway/Adjacent Lands.  A trooper was dispatched to a driver passed out in his vehicle at Speedway in the town of Owego.  The trooper located Drake sitting in the driver’s seat with the car running slumped over and parked at a pump which was out of service.  The trooper was able to wake Drake and after an investigation, he was arrested for DWI.  He was processed and arraigned in the town of Owego court where he was remanded to the Tioga County Jail with no bail.

On June 29, 2019, at approximately 5:30 p.m., New York State Police at Richfield Springs arrested Sean D. Gutierrez, age 34 of Cooperstown, NY for the misdemeanors of Driving While Intoxicated and Aggravated Unlicensed Operation in the third degree.  A trooper was dispatched to a motor vehicle crash at the intersection of Chestnut and Beaver Streets in the village of Cooperstown.  An investigation revealed that Gutierrez had a suspended license and was intoxicated.  His reportable B.A.C was .11%.  Gutierrez was arrested and arraigned in the town of Hartwick court where he was released on his own recognizance.  He will be in court on July 24, 2019, in the town of Otsego. 

On June 29, 2019, at approximately 10:18 p.m., New York State Police at Binghamton arrested Adara L. Tuttle, age 28 of Owego for the misdemeanor of Driving While Intoxicated with a reportable B.A.C of .08%.  A trooper initiated a traffic stop on State Route 17C in the town of Tioga after he observed Tuttle with an equipment violation.  After an investigation, Tuttle was arrested for DWI.  She was later released on appearance tickets to the town of Tioga court on July 17, 2019. 

On July 3, 2019, at approximately 7:35 a.m., New York State Police at Oneonta arrested Michael S. Silver, age 53 of Franklin, NY for the misdemeanors of Driving While Ability Impaired by Drugs, Leaving the Scene of Personal Injury Accident and the violation of Unlawful Possession of Marihuana.  A trooper was dispatched to a hit and run accident on State Route 357 in the town of Franklin and that one vehicle left the scene.  As the trooper was responding to the area, he observed Silver’s vehicle with heavy front end damage.  A traffic stop was initiated on State Route 28 in the town of Oneonta.  An investigation revealed that Silver was impaired by drugs and had a suspended driver’s license.  Silver was arrested and later released on appearance tickets to the town of Oneonta court on July 9, 2019.  The operator of the other vehicle was taken to UHS Delaware Valley Hospital in Walton for arm pain and later released.

On July 3, 2019, at approximately 5:10 p.m., New York State Police at Oneonta arrested Rosa Y. Bautist Pena, age 28 of Yonkers, NY for the misdemeanor of Driving While Ability Impaired by Drugs.  Troopers arrested Bautist Pena after she arrived at the State Police barracks in Oneonta.  While speaking to a trooper on an unrelated matter, he observed common characteristics associated with drug impairment.  After an investigation, she was arrested and later arraigned in the town of Oneonta court where she was remanded to the Otsego County Jail on $50 cash bail or $250 property bond.  She will appear in the town on Oneonta court on July 11, 2019. 

On July 3, 2019,
at approximately 9:58 p.m., New York State Police at Owego arrested Chad M. Warner, age 30 of Nichols, NY for the felony of Driving While Intoxicated (with a prior conviction within 10 years), the misdemeanor of Aggravated Unlicensed Operation in the third degree.  He was also issued traffic tickets.  Troopers responded to a one-car motor vehicle accident with a car into a tree on Decker Hill Road in the town of Nichols.  Troopers located Warner and observed that he appeared to be intoxicated.  Warner was injured but was treated at the scene by Nichols EMS.  A passenger was transported to Robert Packer Hospital for an arm injury.  After an investigation, he was arrested for DWI with a reportable B.A.C of .08%.  Warner was later released to a sober third party.  He will appear in the town of Nichols court on July 18, 2019. 

Darren W. Ryan DWI deja vous all over again

On July 4, 2019, at approximately 2:35 a.m., New York State Police at Endwell arrested Darren W. Ryan, age 28 of Whitney Point, NY for the felonies of Driving While Intoxicated (with a previous conviction within 10 years) and Aggravated Unlicensed Operation in the first degree.  He was also issued tickets for Refusal to Submit to a Breath Test and No Headlamps.  Troopers on patrol stopped a vehicle on State Route 26 in the town of Union that did not have any headlights on.  They also observed the operator unable to maintain his lane and not use a turn signal.  During their interview, troopers observed that Ryan appeared intoxicated.  After an investigation, he was arrested.  Troopers also learned his license was revoked in New York State and he was not operating a vehicle with a court-mandated interlock device.  He was processed and transported to Broome County Central Arraignment and Processing. 

DWI – Drugs arrest of Joshua G. Brown

On July 4, 2019 at approximately 6:38 p.m., New York State Police at Norwich arrested Joshua G. Brown, age 36 of West Monroe, NY for the felony of Criminal Possession of a Controlled Substance in the fifth degree and the misdemeanors of Driving While Ability Impaired by Drugs and two counts of Criminal Possession of a Controlled Substance in the seventh degree.  Troopers responded to County Road 32 in the town of North Norwich for a one-car accident.  Troopers located the vehicle in a cornfield with Brown behind the wheel, conscious but not alert.  Brown was transported to Chenango Memorial Hospital for an evaluation.  An investigation yielded suspected concentrated cannabis, suspected LSD, suspected Psilocybin mushrooms and Marihuana wax.  Brown was arraigned in the town of Norwich court and remanded to the Chenango County Jail on $5,000 cash bail or $10,000 property bond. 

On July 4, 2019, at approximately 11:02 p.m., New York State Police at Richfield Springs arrested Jan Langar, age 54 of Astoria, NY for the misdemeanor of Driving While Intoxicated with a reportable B.A.C. of .16%.  A trooper on patrol at Glimmerglass State Park observed Langar commit multiple traffic violations.  A traffic stop was initiated on Mill Road.  During an investigation, the trooper noted several characteristics indicative of alcohol impairment.  Langar was subsequently arrested and released on appearance tickets returnable to the town of Springfield court on July 18, 2019. 

In separate incidences, the New York State Police arrested four individuals for driving while intoxicated.

New York State Police conducted a DWI Checkpoint in the Village of Horseheads on June 28th.  The driver of a vehicle, Jeffrey Rockwell, age 49 of Catlin, had a strong odor of alcohol coming from him. Rockwell exited his vehicle and was unable to complete field sobriety tests. When Rockwell was processed at the station he was found to have a BAC level of .18%, over twice the legal limit of .08%.

Steuben County 911 dispatched police to a property damage accident on June 29th in the Town of Hornby. Troopers found a vehicle in the ditch and the driver of the vehicle, Shawn Halye age 51 of Hornby, stated that a deer forced him off the road. Halye had been driving home after visiting his brother. He had a strong odor of alcohol and was slurring his speech. Halye was unable to complete roadside sobriety tests. At the station Halye was found to have a BAC of .15%, his vehicle was towed and he was released to a sober third party.

While on routine patrol on Sunday,
June 30th, State Police observed a vehicle driving well under the speed limit on SR 36 in the Town of Hornellsville. The driver of the vehicle Kevin Vantreese, age 23 of Canisteo, told police that he had no license and the registration of the vehicle was no good. Vantreese also told police that he had been drinking and probably shouldn’t be driving. After failing field sobriety tests, Vantreese was processed at the North Hornell station and was found to have a BAC of .33 %, over four times the legal limit of .08%. Vantreese is scheduled to return to the Town of Hornellsville court at a later date.

In the Town of Benton on Sunday, June 30th, State Police observed a vehicle speeding on SR 14. The driver of the vehicle, Arcangel Soler Jr, age 50 pf Penn Yan, told police he was aware of his speeding but was upset over family news. Soler also stated that he had consumed two beers. Soler was unable to complete roadside sobriety testing and was transported to the Dundee station. Soler was found to have a BAC of .12% and was arrested for DWI. He is to return to the Town of Benton court at a later date.
