Simbana-Nunez was under the influence of alcohol when he drove into oncoming traffic and crashed head-on into another vehicle near Paramount Boulevard and Frankel Street in Lakewood.

According to the evidence presented at trial, the defendant sat in his truck following the crash and did not render any aid. A passing motorist pulled over, called 911, and started CPR on the victim following the instructions of the emergency operator, according to witness testimony.

Investigators believe that Jung and Sohn left a local Beverly Hills restaurant in separate cars just prior to the fatal collision. Jung and Sohn are believed to be the drivers of the two vehicles that ultimately struck and killed the victim. Alcohol is believed to have been a factor in the cause of the fatal collision. Additionally, Sohn is currently on probation with Orange County Superior Court due to prior convictions for driving under the influence.
