A state district judge charged with driving while intoxicated had an empty bottle of Mike’s Hard Lemonade in the center console of a Chevrolet Suburban when police pulled her over March 20, according to an arrest affidavit.

Gisela Triana, 48, a civil judge in Travis County since 2005, told the officer that she had consumed four drinks that night, including two during a taping of “Jimmy Kimmel Live” at the Long Center, the affidavit said.

Triana had two more drinks at Zax Restaurant & Bar, according to the affidavit, where she dined with several members of Austin’s legal community, including another judge and defense attorneys and prosecutors.

She was pulled over less than 2 miles from the restaurant on Barton Springs Road near MoPac Boulevard (Loop 1) after the officer’s radar showed she was driving at 47 miles per hour, 17 miles faster than the speed limit, the affidavit said.

Triana was cooperative but her eyes were glassy and she smelled strongly of alcohol, the affidavit said.

Triana swayed as she performed field sobriety tests, according to the affidavit, and at one point took 10 steps in a line before stopping and asking if she could start over because she forgot what step she was on.

“On her second attempt she took very slow, deliberate steps, but still missed heel-to-toe and stepped off line,” the affidavit said.

She refused to give a breath or blood sample to test her blood alcohol level, the affidavit said.
