Maryland: Three judge panel opts for reduced sentence for Kevin Coffay; decision will allow him eligibility for parole in 12 months

ROCKVILLE, MD (WUSA) — Victims’ families reacted with tears and fury Friday night after a three judge panel dramatically cut the sentence for a man who admitted killing three of his friends and fleeing the scene last year in a drunk crash that killed three teens.
The panel cut the 20 year sentence imposed on Kevin Coffay in January to eight years. He will be eligible for parole as soon as next May.
Patrick Hoover, John McQuire and Doug Datt — all fathers who lost their children in the crash last May — said the sentence is like putting a sign out at the county limits, “drunk drivers welcome here.”
Judge Terrance McGann announced the unanimous decision of the three judges. He said, “Kevin Coffay must be incarcerated, but his life should not be wasted or destroyed.” He said the 20 year sentence far exceeded sentencing guidelines. And while he said there is a “culture of recklessness” and excessive drinking among teenagers, he said, “we will not place blame at Kevin’s feet,” for the alcohol…MORE

Kevin Coffay and several friends had left a party. Coffay was drunk, and he slammed a Toyota Corolla into a tree on the side of a Montgomery County road about 3 a.m.
 

Coffay crawled out from behind an airbag and slipped into the woods. Police and tracking dogs found him hours later and miles away, his blood-alcohol level still double the legal limit for driving. Three of his friends were dead or dying. ….MORE

WASHINGTON (WUSA) — A man convicted and sentenced after killing three young people in Olney drunk driving crash has asked for three-judge panel to review his sentence.
In his application for review of his sentence, Kevin Coffay says, “The emotion in this highly public sentencing was overwhelming. I was sentenced to 40 years of incarceration, with 20 years suspended. This sentence is excessive, considering the fact that I never intended to harm anyone and I am a 20 year old first offender. While the consequences of my accident are indeed tragic, and I understand that many people (especially the families of the victims) are angry and demand vengeance, the fact remains that this was an accident ….MORE

The Rockville man who pleaded guilty in connection with a May car crash that killed three of his friends was sentenced to 20 years in prison.
Kevin Coffay, 20, had earlier pleaded guilty Nov. 10 to three counts of manslaughter after the crash that killed three Magruder High School students on May 15.
Coffay told court Thursday that he feels guilt every day.
“I am deeply sorry,” he said.

Maryland: man pleads guilty to killing his 3 passengers after booze cruise on party night ended with trip into tree

A 20-year-old man admitted Thursday that he drunkenly crashed his car into a telephone pole and two trees, killing three of his friendsand injuring a fourth, then fled from the scene.
Kevin Coffay pleaded guilty in Montgomery County Circuit Court to three counts of vehicular manslaughter and one count of fleeing the scene of a fatal crash.
One Magruder High School senior and two recent graduates were killed in the May 15 crash. Another passenger and Coffay, also both Magruder graduates, survived.
Coffay’s blood-alcohol level, taken when he was apprehended after a three-hour chase, was 0.16, twice the legal limit, prosecutor Bryan Roslund said…..MORE

Coffay was previously charged with speeding but plea deal lowered the fine;
also failed to lower his speed to avoid a crash in early morning wreck last year

Kevin Brendan Coffay, 20, of Rockville, Md., was charged with failing to return immediately to the scene of a crash involving bodily injury, was released on bond posted by his mother, Ellen Sue Coffay, of Cutlass Drive in Rockville, Md.
Coffay has two prior charges on his record in addition to charges placed and pending involving the crash on May 15, 2011 at 3:11 am, according to Maryland court records and police reports. Coffay was operating a 2007 Toyota Corolla on Laytonsville Road in Olney when he wrecked, killing 3 of his four passengers.   Coffay fled the scene and police used K-9 dogs to track him down.  
Montgomery County Police have placed charges of failing to render aid and assistance to an injured person, failing to stop after fatally injuring a person and fleeing from police.  A trial date is set for July 12, 2011. 
Rockville attorney Michael McAuliffe is representing Coffay.
On Nov. 26, 2008 Coffay was cited for driving at 83 mph in a 55 mph speed zone on I270 at HOV SKY Ramp and the charge was reduced to 64 mph in a 55 zone with a fine assessed of $67.50 and court costs.
On July 1, 2010 at 3:30 am, he was ticketed by Montgomery County Police Officer D. Berkheimer for failing to control his speed to avoid a collision and he pled guilty resulting in a $130 fine.

and the way to handle that is by going out to booze parties and celebrate his misery by killing three friends…only in
Montgomery County, Maryland would this be an excuse…

Montgomery County State’s Attorney John McCarthy said Kevin Coffay, the driver in the crash which killed three young friends in Olney, had attended two parties prior to the crash and had been drinking.
Prosecutors are actively looking for information and trying to determine who hosted the parties Saturday night.
They’re interested in who provided the alcohol and whether any parents were aware of the parties. Any adults who provided alcohol could face charges.
In charging documents, a police officer claims Coffay, 20, had a “strong odor of alcoholic beverage” at the time of his arrest.  …..MORE
