Idaho: Boise Police note 3 DUI arrests over Labor Day 2013 weekend; Siale I. Vailea spit in cop’s face, yelled racial slurs, say police

Arrested: Joshua P. Hooker, 22, Boise

Charged: Aggravated DUI (F), Leaving the Scene of an Injury Crash (F). Issued citations for Invalid driver’s license (m), Possession of marijuana (m)

Boise Police were called to an injury crash at 11:38 p.m. Friday, August 30th at the intersection of W. Main Street and S. Capitol Blvd. The crash involved a yellow Ford Mustang that had reportedly struck two pedestrians.

The driver of the Mustang drove away from the scene. One of the pedestrians hit was transported to the hospital with what appeared to be non-life threatening injuries. A short time later a few blocks away, officers on foot located a man who was identified to be the driver of the vehicle. While speaking with the man, officers noticed his eyes were bloodshot and glassy and they could smell the odor of an alcoholic beverage.

The man, identified as Hooker, failed field sobriety tests. Officers found the man had no valid driver’s license. Following his arrest, he was also found to be in possession of a baggie containing marijuana. The suspect was arrested on the above charges and booked into the Ada County Jail where a blood draw was taken for further evidence testing.

Arrested: Siale I. Vailea, 22, Boise

Charged: Battery of an officer (F), Malicious Injury to Property (F), DUI (m), Driving without privileges (m), Resisting and obstructing officers (m), No proof of vehicle insurance (m)

A Boise Police officer on patrol on W. Highland Street early Saturday morning, August 31st was nearly hit by another vehicle as it pulled out from a stop sign on northbound Leadville Street.

The officer stopped the vehicle and as he spoke with the driver, could smell the odor of an alcoholic beverage and noticed his speech was slurred. The driver was identified as Vailea. During a check on the driver’s record, the officer found he was driving with a suspended license and had no insurance on the vehicle.

As the officer conducted field sobriety tests, two individuals not related to the stop, walked up to the officer and suspect, began talking to the suspect and attempting to interfere with the ongoing investigation. For the safety of everyone involved, the officer placed the suspect into the back of his patrol car so he could speak with those attempting to interfere.

When the officer returned to the suspect, the suspect had apparently done significant damage to the patrol vehicle’s rear antenna. The suspect was placed under arrest for DUI. While being placed under arrest, the suspect spit in the officer’s face while yelling racial slurs at the officers. A blood test was taken at the jail for further evidence testing. The suspect was booked into the Ada County Jail on the above charges.

VAN VLIET NIGEEN MAHTAUB Boise City Police F DRIVING-UNDER THE INFLUENCE (AGGRAVATED)

Arrested: Nigeen M. Van Vliet, 31, Boise

Charged: Aggravated DUI (F), citation for Failure to purchase a driver’s license (m)

Boise Police were dispatched to a crash where two vehicles had collided on S. Orchard and W. Wright Streets Saturday evening, August 31st.  Both the driver and passenger in one vehicle were transported to the hospital with what appeared to be non-life threatening injuries.

The driver of the second vehicle was identified as Van Vliet. In speaking with her, officers could immediately smell the odor of an alcoholic beverage, her eyes were glassy and bloodshot and her speech was slurred. Officers were able to gather other information that indicated the driver had been drinking alcohol prior to the crash.

The driver, Van Vliet, was transported by Ada County EMS to the hospital where she was treated and released. A blood draw was performed for evidence testing. Following medical attention and upon being released from the hospital, officers arrested Van Vliet on two counts of aggravated DUI. She was also issued a citation for failing to purchase a drivers license. She was booked into the Ada County Jail on the above charge.

*In Ada County the vast majority of those convicted of Aggravated DUI are sentenced to prison time, even when first time DUI offenders

Enhanced DUI:Blood alcohol level of .20 or above:1st time arrest for ENHANCED DUI  equals penalties for normal 2nd time arrests.

2nd arrest (within 5 years) for ENHANCED DUI is FELONY, with penalties equal to 3rd time arrests for standard DUI.
