BEAUMONT, Texas — A three-time deported illegal alien from Mexico, previously convicted of voluntary manslaughter, pleaded guilty Monday, April 15, 2019, to illegally entering the U.S. for the fourth time.

This investigation was conducted by U.S. Immigration and Customs Enforcement’s (ICE) Enforcement and Removal Operations (ERO), and the Texas Department of Public Safety.

Luis Garcia-Torres, a 49-year-old illegal alien from Mexico, pleaded guilty April 15 to unlawful re-entry by a deported alien. According to information presented in court, Garcia-Torres was arrested in Orange County, Texas, on Jan. 13, 2019, for driving while intoxicated. A records check revealed that he had been convicted of voluntary manslaughter in 1988 North Carolina and had been previously deported three times: in 1990, 2011 and 2016. ERO Houston lodged an immigration detainer on Jan. 13 with the U.S. Marshals Service following Garcia-Torres’ arrest.

This case is being prosecuted by Assistant U.S. Attorney Randall L. Fluke, Eastern District of Texas.

Under the federal statute, Garcia-Torres faces up to 10 years in federal prison at sentencing. This maximum statutory sentence prescribed by Congress is provided for information purposes. The actual sentencing will be determined by the court based on the advisory sentencing guidelines and other statutory factors. A sentencing hearing will be scheduled after the U.S. Probation Office completes a presentence investigation.
